Triton Equity Group does not warrant, represent, or guarantee the correctness, completeness, or reliability of any Underwriting Output.
• Not a substitute for professional analysis: Underwriting Outputs do not replace independent due diligence, professional appraisals, legal review, engineering reports, environmental assessments, or any other analysis required to evaluate a commercial real estate transaction. You are solely responsible for conducting your own due diligence.
• No responsibility for deal outcomes: Triton Equity Group is not responsible or liable for any deal, transaction, investment, or financing that does not close, fails, falls through, is rejected by a lender or investor, or otherwise does not proceed for any reason—whether or not you relied on Underwriting Outputs in connection with that transaction.
• No responsibility for financial losses: Triton Equity Group shall have no liability whatsoever for any financial losses, lost profits, lost opportunities, capital losses, or damages of any kind arising from or related to your use of or reliance on any Underwriting Output, including but not limited to losses resulting from inaccurate projections, incorrect calculations, flawed assumptions, or any other deficiency in the platform’s outputs.
• AI-parsed data may be inaccurate: Documents processed through the AI Document Parser (including T-12 financials, rent rolls, and other uploaded files) are extracted using automated artificial intelligence. Parsed data may contain extraction errors, misclassified line items, incorrect figures, or missing information. You are solely responsible for reviewing, verifying, and correcting all parsed data before relying on it for any purpose.
• User-provided inputs: The quality and accuracy of Underwriting Outputs depend entirely on the inputs and assumptions you provide. Triton Equity Group has no obligation to verify, validate, or audit any information you enter into the platform.
• Market conditions change: Real estate markets, interest rates, cap rates, rental rates, operating costs, and economic conditions are dynamic and unpredictable. Underwriting Outputs reflect a point-in-time analysis and may become outdated immediately. Triton Equity Group is not responsible for changes in market conditions that affect the viability of any transaction.

By using the underwriting platform, you assume all risk associated with the use of Underwriting Outputs and agree that Triton Equity Group bears no responsibility for any decisions you make, actions you take, or outcomes that result from your use of the platform.

The underwriting platform and all associated tools, features, and outputs are provided to you at no cost as a free service. You acknowledge and agree that:

• Because this service is provided free of charge, it is offered on a strictly “as is” and “as available” basis with no warranties of any kind, whether express, implied, statutory, or otherwise.
• Triton Equity Group has no obligation to maintain, update, improve, support, or continue offering the platform or any of its features. We may modify, suspend, or discontinue the platform at any time without notice or liability.
• The free nature of this service does not create any professional, fiduciary, advisory, or contractual relationship between you and Triton Equity Group beyond these Terms.
• No payment, consideration, or exchange of value of any kind shall be implied or construed from your use of the platform. You shall have no claim for damages, refund, or compensation related to the platform’s availability, performance, or accuracy.

The Website and platform are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or completeness.

To the fullest extent permitted by law, Triton Equity Group, LLC, its affiliates, officers, directors, members, employees, agents, and contractors will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

• Your use of, reliance on, or inability to use the Website or underwriting platform.
• Any errors, inaccuracies, or omissions in Underwriting Outputs, financial models, projections, or AI-parsed data.
• Any investment, transaction, or deal that fails, does not close, or results in financial loss.
• Any decisions you make based on information provided by the platform.
• Unauthorized access to or alteration of your data or transmissions.
• Any other matter relating to the Website or platform.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if Triton Equity Group has been advised of the possibility of such damages. Because the platform is provided free of charge, our total aggregate liability to you for any and all claims shall not exceed zero dollars ($0.00).

You agree to indemnify, defend, and hold harmless Triton Equity Group, LLC and its affiliates, officers, directors, members, employees, agents, and contractors from any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to: (a) your use of the Website or platform; (b) your reliance on any Underwriting Output; (c) any deal, transaction, or investment decision you make; (d) your User Content; (e) your violation of these Terms; or (f) your violation of any applicable law or regulation.

We may terminate or suspend your access to the Website and platform at any time, with or without cause or notice. Upon termination, all rights granted to you under these Terms will cease, and you must stop using the Website. Termination does not limit any of our other rights or remedies.

Governing Law: These Terms are governed by the laws of the State of Florida, United States of America, without regard to conflict of law principles.

Disputes: Any disputes arising from these Terms or your use of the Website will be resolved through binding arbitration in Fort Myers, Florida, under the rules of the American Arbitration Association (AAA). You waive your right to participate in class actions or class-wide arbitration.

Your use of the Website is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

Entire Agreement: These Terms, together with our Privacy Policy and Disclosures, constitute the entire agreement between you and Triton Equity Group, LLC regarding the Website and platform.
